General conditions: Apartment OSKAR
1. Object of the General Conditions
The landlord rents out for holiday purposes the fully equipped and furnished Holiday house OSKAR, no. 4.03 in the San Marino residence, Albert I Promenade 43 in Ostend, Belgium. This holiday house comprises a living room with open kitchen, 2 bedrooms, bathroom, separate toilet, corridor, patio and a rear sun balcony. The holiday house is rented as a holiday home for max. 6 persons (including children).
It is prohibited for the Renter to sublet the holiday home in whole or in part.
2. Arrival and departure
The rental period starts at 3 pm and ends at 10 am on the day of departure. In consultation with the owner, other times can be agreed.
The Hirer has to inform the Landlord when he will arrive exactly.
3. Reservation
The holiday home can be reserved via the Internet (via online reservation or by e-mail). Please include at least the following information in the application: Name and name of the Hirer, address details of the Hirer, contact details of the Hirer (mobile phone number, e-mail address), number of people and indication of the desired rental period. These details are only requested for the purposes of drawing up the booking confirmation and assessing compliance with the provisions of the General Terms and Conditions. After booking, the Renter will receive a booking confirmation and additional information with the General Terms and Conditions via email.
4. Rent
a) Payment
The full rental price must be paid before arrival. The date the payment is received on the bank account of MML-Projects is considered to be the date of payment. As a result of the payment, the Hirer agrees to the terms and conditions contained in the General Terms and Conditions that have been handed over to him.
b) Payment term
The advance payment amounts to 50% of the agreed rental price (see booking confirmation). This advance payment is to be paid immediately via the payment module in the online booking or within 7 days after the date of the booking confirmation in the case of a reservation by email. The reservation is only binding and final with regard to the Renter and the Landlord in case of the timely payment of the prepayment.
The payment of the remainder of the travel sum is due no later than 4 weeks before arrival. For bookings made less than 4 weeks before arrival, the entire rental price must be paid immediately when booking online or within 7 days after the date of the booking confirmation when booking by email.

c) Non-payment
Non-payment of this amount by the due date automatically implies the cancellation of the rental, whereby the Landlord may keep the advance as compensation. After the cancellation, other guests can book the holiday apartment again and we cannot guarantee the availability of the holiday apartment.
d) The rental price
Within the agreed rental price (see booking confirmation) the normal use of water, gas, electricity is included in the rental price, we ask our guests to deal with this as a good house-mother or house-father.
The rental price also includes final cleaning, bed and bath linen and a starter pack.
e) The deposit
The deposit of €300 must be paid at least 2 working days before arrival ( f) see payment details). If there is no damage or alienation from the holiday home, the Landlord will return the deposit to the Hirer within 10 days after the end of the rental period at the latest on the account number indicated by him.
f) Payment details
The deposit, the balance of the rent, the security deposit as well as all other payments due within the framework of these General Conditions must be paid into the following account number of the lessor specified below.

When making the payment, please always mention the nature of the payment as a free statement: (advance payment, rent + deposit, etc.), the name of the Renter and the rental period.
5. Cancellation
As mentioned above, in the event of non-timely payment of the remaining amount of the of the rental price, this automatically implies that the rental is cancelled, whereby the Landlord may keep the advance as compensation. If the Renter wishes to cancel the rent of the holiday home for any reason whatsoever, he should immediately inform the landlord. This can only be done by email and not by phone. However, the Hirer remains liable for the following amount:

up to 2 months before arrival: 20% of the rental fee

from 2 months up to 1 month before arrival: 50% of the rent

from 1 month before arrival: 100% of the rent
6. Obligations of the landlord and renter
a) Obligations for the lessor
The lessor is obliged to make the holiday home available to the lessee in good condition to the hirer. If the hirer discovers certain defects when bringing the holiday home into use, he must immediately inform the Lessor (see contact details Lessor at the bottom of the agreement), otherwise the holiday home will be deemed to have been handed over by the lessor in good condition.
b) Obligations of the Renter
The Hirer shall occupy the holiday home as a "good family man".
This includes observing the following agreements:

The holiday home is let as a holiday home for max. 6 people (including children).

NO PETS are allowed in the holiday home and NO SMOKING is allowed.

It is forbidden to organise parties in the apartment.

It is forbidden to throw cigarette butts around in the building or on the terrace/balcony.

The Hirer is not allowed to make any changes to the holiday apartment.
-
The Hirer must strictly respect the agreed departure and arrival times.

The Hirer does not have to do any final cleaning, but he will leave the apartment clean.

Upon departure, all dishes should be done and there should be no more waste in the apartment.

When leaving the apartment, the windows and doors have to be closed.

The Hirer is liable for any damage to the holiday apartment caused during the rental period, unless it can be demonstrated that the damage cannot be attributed to the Hirer or his/her fellow travellers. The Renter declares to be sufficiently insured in case he or one of his guests causes damage (family insurance).

Please respect the sleep of the other occupants from 22.00h to 8.00h.
7. Handing over the keys
The keys of the holiday apartment will be handed over on the spot. Two sets of keys will be provided, one for the night door, one for the bottom door and one for the apartment door.
In case of loss of a key, 20€ will be charged; in case of loss of a badge, 50€ will be deducted from the deposit.
8. Inventory
The holiday home includes the following items: two king-size beds and one bunk bed. These beds are - according to the confirmed travel party - made up with a mattress protector, fitted sheet, duvet cover and pillow cases. Towels and tea towels are also provided. A free cot is available on request. You can find a more detailed inventory of the furniture, appliances and household goods in the appendix and in the house itself. Please check the inventory immediately upon arrival. If anything is missing or broken, please inform the landlord on the day of arrival. Otherwise you are responsible for the loss or damage. The Hirer is kindly requested to always inform the Landlord at the end of the rental period whether certain pieces of household furniture need to be replaced (in case of pieces etc). If certain damage arises from the normal use of the various items of household goods and the Hirer has spontaneously communicated this to the Landlord, no compensation will be charged. This measure is mainly motivated by the necessity to always have the holiday home optimally equipped so that the stay for each Hirer can be as pleasant as possible.
9. House Rules
In the holiday home you will find the House Rules of the holiday home, which are intended to promote the good course of affairs in the home and must therefore also be observed by the Renter. It contains the essential information about the operation of domotics, TV, microwave oven, the password for wifi, etc.... as well as arrangements for waste.
The Renter is therefore kindly requested to read these documents carefully at the beginning of his stay.
In case of complaints, they will be immediately taken up with the Renter.
In the case of damage caused by the Renter as a result of non-compliance with the obligations set out in the House Rules, the Renter will be held liable for compensation for the damage caused.
10. Responsibilities
The landlord is not responsible for inconveniences caused by drought, heat, cold, flooding, water shortage, power cuts, storms, external influences and accidents.
11. Final provisions
All disputes relating to this agreement shall be settled exclusively by the courts of Bruges. These General Conditions form an integral part of the booking confirmation. The invalidity of one of the provisions of this agreement does not result in the invalidity of other provisions or the entire General Conditions.
